These Terms & Conditions govern the use of all Saltwater Woman Trade Accounts. By applying for, accessing or using a Trade Account, or by placing an order through your Trade Account, you acknowledge that you have read, understood and agree to be legally bound by these Terms & Conditions.
1. Trade Account Approval
Trade Accounts are available to approved industry professionals, interior designers, architects, stylists and authorised retail partners.
Approval of a Trade Account is at the sole discretion of Saltwater Woman. Saltwater Woman reserves the right to approve, decline, suspend or terminate any Trade Account at any time without prior notice.
Approved pricing is confidential and assigned specifically to your business. Your pricing level may be amended at any time at the discretion of Saltwater Woman.
Trade pricing is not valid in conjunction with sales, promotional offers, discount campaigns or any other pricing incentives unless agreed to in writing.
Any breach of these Terms & Conditions, including misuse of Trade pricing, may result in the immediate suspension or termination of your Trade Account.
2. Ordering
Orders are placed directly through the Saltwater Woman website using your approved Trade Account.
All artworks are made to order.
Production will commence once payment has been been received in full.
Should you require a Tax Invoice for accounting purposes, one will be provided upon request following your purchase. Please allow up to seven (7) business days for processing.
3. Payment
Payment is required in full at the time an order is placed.
As all products are custom made to order, orders cannot be cancelled, amended or refunded once production has commenced.
4. Production & Shipping
Estimated production times are:
- Unframed Prints – approximately 2 weeks
- Framed Prints – approximately 4 weeks
These production times are estimates only and may vary during busy periods.
Shipping charges are calculated at checkout.
Risk in the goods passes to the purchaser upon delivery.
If goods are damaged during transit, Saltwater Woman must be notified within 24 hours of delivery. Photographs of both the packaging and the damaged product must be supplied to enable an insurance claim or replacement assessment. Claims made outside this timeframe may not be accepted by the carrier. Please also refer to the Saltwater Woman Website Terms & Conditions for further information regarding shipping and delivery.
5. Limited Edition Prints
All limited edition prints are supplied with a Certificate of Authenticity.
Edition numbers are allocated at the time of purchase regardless of whether the artwork is purchased framed or unframed.
6. Returns & Refunds
As all artworks are produced to order, Saltwater Woman does not offer refunds, exchanges or credits for change of mind.
Where goods are faulty, damaged in transit or do not comply with the Australian Consumer Law, Saltwater Woman will provide an appropriate remedy in accordance with its legal obligations.
7. Use of Trade Account
Your Trade Account is issued exclusively to your approved business.
Trade pricing is confidential and must not be shared, published, transferred or used by any unauthorised person or third party.
Purchases made using your Trade Account must relate solely to your approved business activities.
Any misuse of Trade pricing, including unauthorised sharing of pricing, purchasing on behalf of non-approved parties, or conduct that undermines the intent of the Trade Program, may result in the immediate suspension or termination of your Trade Account without notice.
8. Images, Copyright & Brand Attribution
Approved Trade Account holders may use imagery supplied by Saltwater Woman, or imagery published on the Saltwater Woman website, solely for the purpose of promoting authorised Saltwater Woman products.
All artwork, photographs, logos, branding and associated intellectual property remain the exclusive property of Annalisa Lawrence trading as Saltwater Woman and are protected under Australian copyright law.
Trade pricing grants the purchaser the right to purchase physical Saltwater Woman products only. It does not grant any copyright, licensing, reproduction, publishing or commercial usage rights beyond the resale of authorised physical artworks where applicable.
Trade Account holders must not reproduce, scan, photograph for reproduction, digitise, copy, alter, license, use in paid advertising, create derivative works from, or otherwise commercially exploit any Saltwater Woman artwork without the prior written consent of Annalisa Lawrence trading as Saltwater Woman.
The purchase of any artwork, whether at Trade pricing or otherwise, does not transfer ownership of copyright or any intellectual property rights. All copyright and intellectual property remain the exclusive property of Annalisa Lawrence trading as Saltwater Woman.
Images may not be altered, edited, reproduced, distributed or used in any manner that is misleading, defamatory or inconsistent with the Saltwater Woman brand.
As part of our Trade Partnership, all reasonable efforts must be made to credit Saltwater Woman whenever artwork is featured on websites, social media platforms, marketing material or promotional campaigns.
Where applicable, posts must include the Instagram tag @saltwaterwoman_.
Failure to provide appropriate attribution on an ongoing basis may result in the review, suspension or termination of your Trade Account.
Saltwater Woman reserves the right to pursue all legal remedies available under Australian copyright and intellectual property law in the event of unauthorised reproduction, commercial use or infringement.
9. Brand Representation
Trade Account holders agree to represent the Saltwater Woman brand professionally, accurately and in a manner consistent with the reputation of the business.
Saltwater Woman reserves the right to refuse future orders or terminate a Trade Account where the brand is misrepresented, intellectual property is misused or these Terms & Conditions are breached.
10. Limitation of Liability
To the maximum extent permitted by law, Saltwater Woman shall not be liable for any indirect, incidental or consequential loss arising from the use of a Trade Account or the purchase of products.
Nothing within these Terms excludes or limits any rights or remedies available under the Australian Consumer Law.
11. Amendments
Saltwater Woman reserves the right to amend these Terms & Conditions at any time.
The current version published on the Saltwater Woman website will apply to all future orders placed through a Trade Account.
12. Governing Law
These Terms & Conditions are governed by the laws of New South Wales, Australia.
Any dispute arising from these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of New South Wales.
Acceptance
By creating a Trade Account, accessing Trade pricing or placing an order through your Trade Account, you acknowledge that you have read, understood and agree to be legally bound by these Terms & Conditions.
